Owning Property in Koh Samui

While technically foreign land ownership is not generally available in Thailand, and more specifically Koh Samui, partly foreign owned corporations are permitted to own land.

The law in Thailand requires that Thai citizens hold the majority of the shares in any company but, at the same time, different types of shares types are available. Shareholders holding ordinary shares are entitled to one vote per share. Preferred shares allow the shareholder multiple votes. This system allows for the distribution of preferred shares to be held in majority by foreign partners and therefore allow the foreign partners control over operations while still abiding by Thai law.

The purchase of a Condominium is covered by different rules that state that a foreigner can be the legal owner of a condominium providing the percentage of foreign owned living space in the entire block does not exceed 49%, and, that the funds used to purchase the condominium have been remitted from abroad, and that this transaction has been recorded by a Thai Bank on a Foreign Exchange Transaction Form. Once the purchase has been made the owner of the unit will be provided with a Chanote title deed as proof of ownership.

While foreigners are not permitted to own land in Thailand they are permitted to own buildings. This allows for a foreigner to obtain a long term lease on land, either owned by a Thai national or a partly foreign owned company, and then own the building or dwelling on that land.

Previous to the year 1998 any Thai who entered into a marriage with a foreigner lost the right to purchase land in Thailand after their marriage. Any land purchased before the union however was permitted to be retained. This law changed in 1999 and providing the Thai national married to a foreigner can prove that monies used to buy the land are not subject to any foreign claim they are permitted to purchase land.

If you wish to invest in a Koh Samui property and wish to see a healthy return on your investment by renting to a third party Thai law allows for this providing you own the lease on the land the property sits on. Rental revenue is subject to a 12.5% tax on the annual income.

How did SCL get started and where can I find it?

There are 4 private schools in Koh Samui that you might want to consider if you are moving to the island. Samui Centre of Learning started out in 2005 with just two students (both of whom are still studying here) and used a traditional Thai house as the school building. Since then, the school has expanded to offer a British curriculum to almost 150 students and in 2009, a brand new school was built near the Buddy Hotel.

Can I enrol my children at SCL?

All schools in Koh Samui accept boys and girls. Samui Centre of Learning is no different, accepting boys and girls from age 2-16 and taking them from pre-nursery through to their IGCSE. The school accepts a large number of local Thai children but also welcomes children from Bangladesh, the Philippines, Germany and Russia. The children wear a uniform Monday-Thursday and are allowed to wear their own clothes on Friday. Nonetheless, the school expects them to be presentable at all times.

What is the quality of the teaching like at SCL?

Of all the schools on Koh Samui, Samui Centre of Learning prides itself on only hiring staff that have a teaching degree makes. The school headteacher, had this to say:

Every child at SCL speaks at least two languages and this can make teaching a real challenge. We keep the number of children in each class low and as such, can offer a student-teacher ratio of 9:1.

What will my children learn at SCL?

The curriculum at the schools on Koh Samui differs between institutions. At SCL, children follow a British curriculum that covers numeracy, literacy, science, ICT, P.E. The children learn Thai language and culture 6 times per week as well as learning Chinese and Music. The school features a computer lab with 10 networked PCs which greatly supplements classroom teaching. The school tries to organise regular events out of school; there are two school fairs each year and recently the children helped to clean up Hua Thanon beach. After school clubs are largely dependent on the skills of the teaching staff but SCL manages to offer poi club, swimming lessons, English tuition, musical theatre and sports club.

Thailand’s Property market set to grow in 2nd half of 2010

Thailand’s home building market will continue its growth in the second half of 2010 but the market value as a whole will drop slightly year-on-year according to the latest Property Market reports.

Political instability in the past months affected the market. Numbers of new build units in Bangkok dropped but the market in the outlying areas and upcountry continued to grow in the first half of 2010. According to the report, the market value is expected to grow only 3-5 per cent, lower than the previous expectation of 5-8 per cent.

PD House’s research and business development department also conducted an online survey of 2,548 people on consumer attitudes nationwide on the preferred financial source for new home building. The survey showed that almost 80 per cent of the target group would get a loan from banks rather than use their own savings. This is quite the opposite to the results conducted 5-6 years ago where over 60 per cent preferred using their own savings to build a new house.

Sitthiporn Suwannasut, Chairman and Director-General of PD House Home Builder Centre, said that over 70 percent of its clients would apply for a mortgage to build their new home during the past 5-6 months.

“This is a growing trend. In the past, consumers thought that it was difficult and complicated to get a home loan from the banks. Some didn’t even realise that they were allowed to do that. But now it’s something different,” said Sitthiporn. “Most people believe that their dreams of having a new house could become true more easily once they manage to get a loan while some don’t think they can save enough money to keep up with the increasing house prices”.
